Member Arbitration Notice

Important notice
Article 8 of the High Vibes Health Collective Private Membership Association Agreement contains the controlling agreement requiring covered disputes involving a Store Applicant or Member to be resolved through binding individual arbitration rather than a court trial.
The controlling Member Agreement provision includes:
- administration under the AAA Consumer Arbitration Rules;
- one neutral arbitrator;
- application of the Federal Arbitration Act;
- an individual small-claims-court option;
- reasonable consumer costs under AAA rules;
- document, telephone, video, or reasonably convenient in-person procedure;
- waiver of class, collective, consolidated, representative, and jury proceedings to the extent permitted by law;
- preservation of nonwaivable public-injunctive and consumer rights.
Relationship to Store Terms
The Store Terms of Sale and this notice do not create a second or inconsistent arbitration agreement. Where a Store instrument and the Member Agreement differ, the Member Agreement controls, subject to nonwaivable law.
No separate Store arbitration opt-out is offered by this notice. Any change to the Member Agreement’s dispute provisions must be adopted through the Member Agreement’s amendment process and presented for any required affirmative acceptance.
Checkout acknowledgement
The required membership checkbox is the checkout assent in Appendix A of the Member Agreement. The Private Membership Association Agreement text must link directly to the exact version being accepted:
