Website Terms of Use

1. Acceptance and scope

These Website Terms of Use govern access to and use of rejuvajar.com, rejuvajarstore.com, associated public pages, content, forms, customer accounts, and website functions collectively identified as the “Sites.”

Access or use after presentation of these Terms constitutes acceptance of these Terms. A product order remains additionally governed by the Store Terms of Sale. Store checkout also follows the separate membership-admission process in the Member Agreement. The Member Agreement and private Association governing instruments control any inconsistency, subject to nonwaivable law.

2. Operator

High Vibes Health Collective, a private membership association, operates the Sites. For these Terms, “Association” means High Vibes Health Collective.

3. Eligibility

Site accounts and Store membership applications or purchases are limited to natural persons at least 18 years of age and entities acting through an authorized adult representative. Site use by a minor requires lawful adult supervision, but no minor may open an account, apply for membership, or place an order.

4. PMA status

Site access does not constitute admission into the Association. Account status and mailing-list status do not establish membership. A Store Applicant may be admitted only through the affirmative membership-assent, payment, and Association-acceptance process in the Member Agreement. No provision in these Terms modifies the Association’s private membership rules or takes precedence over the Member Agreement.

5. Limited website license

Subject to these Terms, the Association grants a limited, revocable, nonexclusive, nontransferable license to access and use the Sites for lawful personal or internal business purposes.

The license excludes:

  • reproduction or republication of Site content;
  • commercial exploitation of Site content;
  • creation of derivative works;
  • scraping, crawling, data harvesting, or automated extraction not authorized in writing;
  • framing, mirroring, or embedding of Site pages;
  • use of marks, product images, manuals, or copy in another storefront;
  • reverse engineering or interference with Site code or security;
  • resale or sublicensing of Site access.

6. Accounts and account security

Account information must remain accurate and current. Account credentials must remain confidential. Activity occurring through an account may be attributed to the account holder when reasonable authentication measures establish account access.

Unauthorized access, credential compromise, or suspected fraud should be reported promptly through the Store contact page or telephone number.

The Association may suspend or close an account affected by fraud, security risk, unlawful use, chargeback abuse, or material breach.

7. Prohibited conduct

The following conduct is prohibited:

  • violation of law or third-party rights;
  • fraudulent orders or payment activity;
  • introduction of malware or harmful code;
  • interference with Site operation or another user;
  • impersonation or false affiliation;
  • unauthorized access to accounts, servers, or data;
  • circumvention of security, rate limits, or access controls;
  • harvesting contact or personal information;
  • submission of unlawful, infringing, deceptive, threatening, or abusive material;
  • misuse of Association or Rejuva Jar® marks;
  • use of Site content to train, populate, or operate a competing product catalog without written authorization.

8. Reviews, messages, and other submissions

A submission must be truthful, relevant, lawful, and based on rights held by the submitter. A submission must not include another person’s private information without authority.

A nonconfidential submission grants the Association a worldwide, nonexclusive, royalty-free license to host, reproduce, format, display, and distribute the submission for Site operation, customer support, moderation, and lawful promotion. Personal information remains governed by the Privacy Notice.

The Association may moderate or remove a submission for policy, safety, relevance, quality, or legal reasons. No obligation exists to publish a submission.

9. Intellectual property

All Site content, page design, graphics, photographs, text, manuals, media, software, trademarks, service marks, trade dress, and associated goodwill remain owned by the applicable rights holder or used under lawful authority.

REJUVA JAR® and HIGH VIBES HEALTH COLLECTIVE® may be used only as authorized by the applicable rights holder. No implied license arises from Site access.

10. Product and informational content

Site content provides general product and educational information. Site content does not create a professional, medical, fiduciary, advisory, or confidential relationship.

Current product labeling, warnings, and Instructions for Use control over informal website summaries. Product-specific warranty rights remain governed by the Limited Product Warranty.

11. Third-party services and links

The Sites may link to payment processors, carriers, social platforms, external publications, member resources, reseller resources, or other third-party services. Third-party terms and privacy practices govern third-party services.

A link does not establish sponsorship, endorsement, control, or responsibility unless an express written statement provides otherwise.

12. Site availability and corrections

Site access may be interrupted for maintenance, security, updates, technical failure, or events beyond reasonable control. The Association may correct typographical errors, technical errors, product descriptions, availability information, and pricing before order acceptance.

Material terms accepted for a completed order cannot be retroactively changed through a later website edit.

13. Privacy

The Privacy Notice, Consumer Health Data Privacy Policy, and Cookie Notice govern data handling. Privacy notices provide disclosures and rights; privacy notices do not convert personal information into Association property.

14. Suspension and termination

The Association may suspend or terminate Site access for unlawful conduct, security threats, fraud, material breach, or interference with Site operation. Termination does not eliminate payment obligations, intellectual-property restrictions, dispute provisions, or rights arising before termination.

15. Website warranty disclaimer

THE SITES ARE PROVIDED ON AN “AS AVAILABLE” BASIS. TO THE MAXIMUM EXTENT PERMITTED BY LAW, THE ASSOCIATION DISCLAIMS WARRANTIES CONCERNING UNINTERRUPTED ACCESS, ERROR-FREE OPERATION, OR THE COMPLETENESS OF GENERAL WEBSITE CONTENT.

THIS SECTION DOES NOT LIMIT ANY EXPRESS PRODUCT WARRANTY, NONWAIVABLE IMPLIED WARRANTY, PERSONAL-INJURY RIGHT, PRIVACY RIGHT, OR OTHER RIGHT THAT CANNOT LAWFULLY BE LIMITED.

16. Limitation of website-related liability

To the maximum extent permitted by law, liability arising solely from ordinary Site access will not include indirect, incidental, special, exemplary, or consequential damages that were not reasonably foreseeable.

No limitation applies to fraud, willful misconduct, infringement, breach of confidentiality, violation of privacy rights, personal injury, product liability, or another liability that cannot lawfully be excluded.

17. Responsibility for unlawful misuse

A Site user remains responsible for losses, claims, or costs directly caused by unlawful misuse of the Sites, infringement of third-party rights, fraud, or malicious interference with Site operation.

18. Dispute resolution

A dispute involving a Store Applicant or Member is governed by Article 8 of the Member Agreement, which controls any inconsistency with a Store instrument or Member Arbitration Notice.

Public Site access alone does not create a PMA arbitration agreement. A dispute limited to public Site access and not connected to a membership application, Member status, or Store order remains subject to applicable law and lawful jurisdiction.

19. Changes

A revised version applies prospectively from the posted effective date. Material changes will receive reasonably conspicuous notice. A prior completed order remains governed by the version accepted for that order.

20. General terms

Invalidity of one provision does not invalidate the remaining provisions. Failure to enforce a provision does not waive later enforcement. No assignment by a Site user may occur without written consent. The Association may assign Site operations in connection with a lawful reorganization, succession, license, or transfer, subject to applicable privacy restrictions.
